These Terms of Use (“Terms”) govern your access to this website and all other applicable websites operated by SSCOR, Inc. (“SSCOR”) (collectively, the “Site”), as well as your purchase of any devices, components, parts, or other goods made available through the Site (collectively, the “Products”).

BY ACCESSING OR USING THE SITE, YOU (“YOU”) AGREE THAT YOU HAVE READ AND UNDERSTAND THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT ACCESS OR USE THE SITE.

We may modify these Terms at any time. All changes will be effective immediately upon posting to the Site. Material changes will be conspicuously posted on the Site or otherwise communicated to you. By using the Site after changes are posted, you agree to those changes.

1. Content.
The Site, including its text, audio, video, graphics, charts, photographs, interfaces, icons, software, computer code, data, trademarks, logos, slogans, documentation, other components and content, and the design, selection, and arrangement of content, and all intellectual property rights in the foregoing (collectively, the “Content”) are exclusively the property of SSCOR or, as applicable, its vendors or licensors. Except for the rights expressly granted to you in the next section, SSCOR reserves all other rights in and to the Site and Content, including all intellectual property rights.


2. Use Rights.
You may only use the Site or Content for your personal, non-exclusive use in the United States, so long as you comply with these Terms and all other terms posted throughout the Site as applicable to you (if any), and all applicable laws. You may only use the Site and the Content for their intended purposes for which they are made available to you by SSCOR.


3. Use of Marks.
SSCOR owns certain trademarks, names, logos, insignia, or service marks (“Marks”). You do not have the right to use any Marks except as expressly agreed to in writing by SSCOR. In addition, the Site may contain third-party marks and third-party copyrighted materials, which are the property of their respective owners. Nothing in these Terms grants to you any rights in or to those third-party marks or materials without such third-party's consent.


4. Intellectual Property Rights.
The Site and Content are protected by copyright, trademark, and other intellectual property laws. Any unauthorized use of any trademarks, trade dress, copyrighted materials, or any other intellectual property belonging to SSCOR or any third party is strictly prohibited and may be prosecuted to the fullest extent of the law.


5. Account.
To access certain features of the Site, including placing orders, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to maintain and promptly update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You accept responsibility for all activities that occur under your account, whether or not authorized by you. You agree to notify SSCOR immediately of any unauthorized access to or use of your account. SSCOR reserves the right to suspend, restrict, or terminate accounts at its discretion, including where information provided is inaccurate or where these Terms are violated.


6. Orders.
All orders are subject to acceptance by SSCOR. You are solely responsible for reviewing and verifying all order details prior to submission, including but not limited to Product specifications and quantities. Orders may not be cancelled without the consent of SSCOR. If a customized or non-standard order is canceled after production or assembly has commenced, you shall be responsible for a restocking fee of up to twenty percent (20%) of the total order value, regardless of shipment status. Once an order has been submitted and production has begun, it may not be modified or canceled except at SSCOR’s sole discretion. SSCOR reserves the right to refuse or cancel any order for any lawful reason, including suspected fraud, inaccuracies, or errors in pricing or Product description.


7. Product Availability.
Product availability is subject to change at any time without notice, and SSCOR does not guarantee that any Product will be in stock or available at any given time. Inclusion of a Product on the Site does not guarantee its availability. SSCOR reserves the right, in its sole discretion, to limit quantities, reject any order (in whole or in part), or discontinue or modify any Product at any time.


8. Representations Regarding Authorized Use.
By placing an order with SSCOR, you represent and warrant that: (a) you have full legal authority to purchase the Products from SSCOR, whether on your own behalf or on behalf of the entity you represent; (b) you will purchase, use, and, where applicable, distribute the Products in full compliance with all applicable federal, state, and local laws, regulations; and (c) all information provided by you is accurate, complete, and current.  You acknowledge that federal law restricts the use of certain medical devices to or on the order of a physician, emergency medical technician, or other qualified medical practitioner, and that the Products available for purchase on the Site are intended for use only by properly trained medical or EMS personnel. SSCOR does not verify the credentials of any purchaser, recipient, or user and shall not be responsible for any unauthorized or improper use of the Products.


9. Pricing and Payment.
All prices are listed in U.S. dollars and are subject to change without notice. Payment in full is required at the time of order. By submitting payment information, you authorize SSCOR and its third-party payment processors to charge the total order amount, including applicable taxes, shipping fees, handling charges, and any other disclosed fees, to your selected payment method. You represent and warrant that you are authorized to use the designated payment method. SSCOR reserves the right to refuse or cancel any order if payment authorization is declined or if fraudulent activity is suspected. If you wish to submit payment on credit and receive an invoice, you must complete a credit application and provide any requested supporting documentation. Approval of credit terms is at SSCOR’s sole discretion and is subject to any additional terms and conditions provided at the time credit is granted. 10. Shipping and Delivery.
Shipping and delivery dates provided at checkout are estimates only and are not guaranteed. SSCOR is not responsible for delays caused by shipping carriers, incorrect or incomplete shipping information provided by you, acts of God, weather events, supply chain disruptions, or other circumstances beyond its reasonable control. Risk of loss and title for Products pass to you upon delivery of the Products to the carrier. You are responsible for providing an accurate shipping address. SSCOR is not responsible for lost, stolen, or misdelivered packages resulting from incorrect information provided by you.


11. Returns.
Returns require prior authorization from SSCOR and the issuance of a Return Material Authorization (“RMA”) number. You must contact SSCOR customer service by emailing sales@sscor.com. or calling 818-504-4054 to obtain an RMA number before returning any Products. SSCOR may require you to provide photographs or other documentation of the product as a condition of issuing an RMA. New, unused, and unopened Products may be returned within thirty (30) days of delivery for a refund. Batteries and disposable items are non-returnable unless defective. All approved returns are subject to a restocking fee of up to twenty percent (20%) of the purchase price. You are responsible for all return shipping costs. All returned Products must be received and inspected by SSCOR, and any refund or credit is contingent upon the Products being in saleable condition.


12. California Proposition 65.
Certain Products available on the Site may be subject to warning requirements under California’s Proposition 65 (Safe Drinking Water and Toxic Enforcement Act of 1986). Where required, warnings will be provided in accordance with applicable law, including on relevant product pages or with the Product. For more information, please visit www.P65Warnings.ca.gov.


13. Compliance with Laws.
In connection with your access to and use of the Site, you are responsible for complying with all applicable laws, regulations, and rules of all relevant jurisdictions, including all applicable rules regarding online conduct.


14. Children's Information.
The Site is not directed at children under the age of eighteen (18) years old. If you are under eighteen (18) years old, you must immediately stop using the Site.


15. Restrictions on Your Use of the Site.

1. You will not copy, duplicate, sell, publish, post, license, rent, distribute, modify, translate, adapt, reverse-engineer, or create derivative works of the Site or Content without SSCOR’s prior written consent.
   
   
2. You will not use the Site for unlawful purposes.
   
   
3. You will not submit inaccurate, incomplete, or out-of-date information via the Site, commit fraud or falsify information in connection with your use of the Site.
   
   
4. You will not engage in data mining or similar data gathering or extraction activities from the Site. You will not use the Site to harvest email addresses, names, or other information of the users of the Site or to spam other users of the Site.
   
   
5. You will not access, use, or copy any portion of the Site or Content, through the use of indexing agents, spiders, scrapers, bots, web crawlers, or other automated devices or mechanisms.
   
   
6. You will not use the Site to post, transmit, input, upload, or otherwise provide any information or material that contains any viruses, worms, Trojan horses, malware, ransomware, adware, or other harmful computer code that may disable, damage, impair, or otherwise interfere with the Site, the servers used to make the Site available, or any other network, computers, hardware, software or systems.
   
   
7. You will not engage in activities that aim to render the Site or associated services inoperable or to make their use more difficult.
   
   
8. You may not frame, mirror, or circumvent the navigational structure of any part of the Site.
   
   
9. You may not engage in any conduct while using the Site that SSCOR considers inappropriate, unauthorized, or contrary to the intended purpose of the Site.

16. Feedback and User Content.
If you submit comments (such as on blog posts) or feedback to us regarding the Site or its Content, or any other comments, questions, requests, content or information that is not personal information ("User Content"), we may use any comments and feedback that you send us in our discretion and without attribution or compensation to you.

SSCOR MAKES COMMERCIALLY REASONABLE EFFORTS TO ENSURE THAT ALL CONTENT ON THE SITE IS ACCURATE AND RELIABLE, BUT NEITHER ACCURACY NOR RELIABILITY ARE GUARANTEED. SSCOR DOES NOT WARRANT OR GUARANTEE THE QUALITY, COMPLETENESS, TIMELINESS, OR AVAILABILITY OF THE SITE OR CONTENT. SSCOR DOES NOT WARRANT OR GUARANTEE THAT THE SITE OR CONTENT WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY DEFECTS IN THE SITE OR CONTENT WILL BE CORRECTED, OR THAT THE SITE OR THE SERVERS THAT MAKE THE SITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL CONDITIONS OR COMPONENTS.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WE DO NOT WARRANT OR ENDORSE ANY THIRD-PARTY CONTENT.

ALL PRODUCTS SOLD BY SSCOR ARE SUBJECT SOLELY TO THE TERMS OF THE APPLICABLE LIMITED WARRANTY, AND SSCOR DISCLAIMS ALL OTHER WARRANTIES WITH RESPECT TO SUCH PRODUCTS TO THE MAXIMUM EXTENT PERMITTED BY LAW. SSCOR’S WARRANTY POLICY FOR PRODUCTS IS AVAILABLE HERE.

YOUR SOLE AND EXCLUSIVE REMEDY IS TO STOP ACCESSING AND USING THE SITE OR CONTENT.

WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL THE AGGREGATE LIABILITY OF THE SSCOR PARTIES ARISING OUT OF OR IN CONNECTION WITH THE SITE OR CONTENT, OR YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR CONTENT EXCEED $100 U.S.D., EVEN IF ANY REMEDY PROVIDED FAILS OF ITS ESSENTIAL PURPOSE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.
